Fatal Accident Involves Bus And Dragging

It often seems as though life is too short, and for some Baltimore residents, that unfortunately happens to be the case when a person dies unexpectedly. When a fatal accident suddenly claims a person’s life, it is not only tragic for the individual involved, but for the surviving friends and family members as well, who are left in a painful and difficult situation.

One fatal accident recently claimed the life of a mother of four children. The woman was crossing the street to bring some mail to the post office when she was struck by an oncoming bus. The bus continued on and dragged the woman about 20 feet before the driver of the bus stopped and backed up.

Officials indicated the woman had been walking properly in the crosswalk at the time of the incident, and the bus driver apparently did not see her before striking her. No charges have yet been filed against the bus driver.

Typically, when another person’s negligence caused the death of a person, a wrongful death action may be brought against the negligent party. Surviving family members can obtain damages for the person’s death, such as damages to compensate for the person’s lost income.

There are also damages typically available if the deceased person suffered personal injury before the death. Through a survival action, the estate of the deceased person can bring an action to recover damages for the person’s pain and suffering. A jury in these cases may consider whether the person was conscious before death and suffered pain, and award damages to the person’s estate for that pain and suffering.
