Holding truck drivers accountable for their actions

Actions have consequences, as the saying goes. Even the seemingly most insignificant choice can lead to devastating results.

Perhaps nowhere is this more true than on the road. A person's decision to drink and drive, text and drive or engage in other conduct may lead to a serious accident causing injury to others. For instance, last week this blog discussed the alarming number of times a tractor trailer accident occurs because of truck driver fatigue.

When a truck driver's action, or inaction, causes a truck accident that injures others, the injured persons may have a legal claim they can assert against the driver and trucking company. The truck driver has a duty of care he or she owes to other individuals on the road. Accordingly, when the truck driver takes actions or fails to act in a manner that hurts others, the driver may have violated this duty of care. The driver can then be held accountable for his or her negligence.

This might include checking the driver's trucking logs and other documents to determine how long the driver had been on the road at the time of the accident and how much rest he or she had.
